A. INTRODUCTION

  • By viewing or using tips on Tipstake.com website or any of our affiliate sites, pages, accounts and/or signing up on the website, you agree to be bound by and to comply with our

    1. these Terms and Conditions;
    2. our Privacy Policy;
    3. our Cookies Policy and
    4. the Rules applicable to all our products.

Please read the Terms carefully and if you do not accept the Terms, do not use the Website. The Terms shall apply to all tipstake.com sites and affiliate accounts.

  • There would be the need to change Terms and our conditions from time to time for a number of reasons (including complying with applicable laws and regulations, and regulatory requirements as well as we deem fit in order to satisfy our users). As changes would be made, you are therefore advised to review the Terms on a regular basis. All major updates on the Terms and conditions and their dates of effect would be posted on the site. Should you have any issues or should any change made be unacceptable, please you are thereby advised to close your account with us. However, signing up to tipstake.com indicates an agreement with our Terms and Conditions and our policies.

  • Please note that references used such as "you", "your" or the "user" refers to any person using the website or the services of Tipstake.com and/or any of our affiliate sites as well as all signed up persons while "we" "our" and "Tipstake.com" refers to Tipstake and its management.

  • Please beware that right and access to Tipstake.com as well as all our social media handles may be illegal in certain countries. You are therefore responsible for determining whether your access and use of the Website is not prohibited and is compliant with applicable laws, regulations and abiding policies in your jurisdiction.

  • Tipstake is committed to providing excellent user service. By providing excellent service we ensure that risks are reduced to their lowest minimum. As part of our commitment, Tipstake is committed to supporting responsible use of the platform. We advise that all users are 18+. We do not accept any responsibility or liability if any user uses the Tipstake.com and its affiliate site such as its social media contents with the intention of deliberately avoiding the relevant measures, laws, policies and regulations in place.

B. YOUR TIPSTAKE ACCOUNT

B1. Application

  1. All users must be over 18+ years to sign up with Tipstake. Tipstake reserves the right to ask for proof of age from any user and suspend their account until satisfactory documentation is provided.
  2. 2. Tipstake may confirm a user's account by sending email verification to the user. Users only get correspondence after email verifications have been confirmed. Please note that Tipstake does not request for users' information via calls on the verifications of accounts.
  3. 3. By accepting the Terms and signing up to use the Website, analysis and tips you hereby agree that we shall be entitled to conduct identification, credit and verification checks periodically that are required by applicable laws and regulations and relevant regulatory authorities for use of the Website and our Services generally. Also by signing up you agree to provide all such information as we require in connection with such verification checks. We shall be entitled to suspend or restrict or delete accounts of users in any manner that we may deem in our absolute discretion to be appropriate.
  4. 4. Users may open only one account. Information accessed by you on the Website (including results, tips, and odds etc.) is for your personal use only and the distribution or commercial exploitation of such information is strictly prohibited unless the user is given the permission to do so. Should we identify any user with more than one account or users reposting and sharing exclusive information explicitly, we reserve the right to treat any such accounts as one joint account or expressly delete such accounts when necessary.
  5. 5. Users are advised to keep accounts up to date to ensure that they continue to receive emails, notifications and also make themselves eligible to use the platform.

B2. Account Details

  1. Tipstake allows all its users to choose their own username and password combination. Users must keep this information confidential as you are responsible for all activities on the account.

  2. Once your account has been upgraded to a subscription plan, subscription begins (whether or not you make use of odds provided, Do not have access to your account or forgot your password).

  3. If, at any time, you feel a third party is aware of your username and/or password you should change it immediately via the Website. Making use of the "forgot my password" option.

  4. Your Current Subscription status will always be displayed on the dashboard of users' accounts.

B3. Personal Details

  1. By signing up, users have entrusted us with their emails and subscription details, we are therefore obligated to protect the information of our users.

B4. Deactivation of Account

  1. You may stop using the Services, close your Tipstake Account, and cancel these Terms at any time by contacting us at hello@Tipstake.com, using "Deactivate" as subject and providing sufficient information for us to verify your identity. Notwithstanding the preceding, if there are any pending transactions relating to your Tipstake Account when we receive your deactivation notice, we will close your Tipstake Account promptly after such transactions are completed. Your termination of these Terms will not affect any of our rights or your obligations arising under these Terms prior to deactivation.

  2. Upon the deactivation of your Tipstake Account, we will place on hold the funds in your Tipstake Balance, if any. If you do not use the Services for a certain period, applicable law may require us to report the funds in your Tipstake Balance as unclaimed property. If this occurs, we may try to reach you with your contact details shown in our records. If we are unable to reach you, we may be required to deliver any funds in your Tipstake Balance to the applicable state as unclaimed property. The specified period to report and provide funds varies by state.

  3. The account can be re-activated by Admin only if it was suspended by the Admin, but through the request from the customer, by following the procedure of sending a mail to: hello@tipstake.com and stating reasons for re-activation. Tipstake is under no obligation to reject such a request. 4. Provisions of these Terms that, by their nature, should survive termination of these Terms will survive termination of these Terms.

C. TIPS AND PICKS

C1. Tipstake does not provide tips, but can give users recommendations which they are in no obligation to follow and also to act as a platform for peer-to-peer communication and analysis to enrich the sport trading community. At its best, tipstake provides a means for users to insure their purchase of tips and picks by providing a reasonable guarantee on the analysis results and tips purchased and sold within the tipstake platform.

C2. We are therefore not responsible for failing outcomes of events as all tips and event analysis end before the event takes place and final outcomes are decided. Information on the site should not be relied upon absolutely when making trades and tips. Tips are ultimately purchased at users own risk and discretion.

D. OTHER

D1. Tipstake may actively monitor traffic to and from the Website. Tipstake reserves the right in its sole discretion to block access where evidence indicative of automated, robotic or programmed activities are found.

D2. Tipstake reserves the right to restrict access to all or certain parts of the Website at its discretion.

D3. Tipstake may alter or amend the products offered via the Website at any time and for any reason.

D4. From time to time, all or part of the Website may be unavailable for use by you because of our maintenance of the Website and alteration or amendment of any of the Website categories. We will ensure that proper notice is given prior to the unavailability of such parts.

E. OUR LIABILITY

E1. Tipstake does not accept any liability for any damages, liabilities or losses which are deemed or alleged to have arisen out of or in connection with services, analysis, recommendations and tips on the Website or its affiliates.

E2. While Tipstake endeavors to ensure that the information on the Website is correct, Tipstake does not warrant the accuracy or completeness of the information and material on the Website. The Website may contain typographical errors or other inaccuracies, or information that is out of date. Tipstake is under no obligation to update such material.

E3. The information and material on the Website is provided "as is", without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, Tipstake provides you with the Website on the basis that Tipstake excludes all representations, express or implied warranties, conditions and other terms which but for these terms and conditions might have effect in relation to the Website.

F. OUR INTELLECTUAL PROPERTY RIGHTS

The contents of the Website are protected by international copyright laws and other intellectual property rights. The owner of these rights is Tipstake, its affiliates or other third-party licensors. Any commercial use or exploitation of the platform or its content is strictly prohibited.

G. OTHER PROVISIONS

G1. In no event will any delay, failure or omission (in whole or in part) in enforcing, exercising or pursuing any right, power, privilege, claim or remedy conferred by or arising under these Terms and Conditions or by law, be deemed to be or construed as a waiver of that or any other right, power, privilege, claim or remedy in respect of the circumstances in question, or operate so as to bar the enforcement of that, or any other right, power, privilege, claim or remedy, in any other instance at any time or times subsequently.

G2. If any provision of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions which shall remain in full force and effect.

G3. Nothing in these Terms and Conditions shall create or be deemed to create a partnership, joint venture or principal-agent relationship between the parties and no party shall have authority to bind any other in any way unless expressly provided otherwise in these Terms and Conditions.

G4. Tipstake shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control including (without limitation) any telecommunications network failures, power failures, failures in third party computer hardware or software, fire, lightning, explosion, flood, severe weather, industrial disputes or lock-outs, terrorist activity and acts of government or other competent authorities. In such circumstances the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed.

H. CANCELLATION/REFUND POLICY

  • H1. Terms of Refund: Please note that other than the refund of your payment for a tip that doesn't occur as analyzed, tipstake does not offer any refund.

  • H2. Subscriptions: You can choose to subscribe to more than one analyst/pundit. You can choose not to subscribe, if after a certain week you are not satisfied with the tips you got. You can also choose to subscribe to tipstake recommendations if you want to, as we do not obligate users to make use of subscription features.

I. BALANCE SYSTEM

I1. These general terms and conditions shall govern your use of the Tipstake Balance related services.

I2. You shall have three Balances. The first Balance is the MAIN Balance which can be sent to your bank account. The second Balance is the GAME Balance balance, which is used as a confidence measure by other users to ascertain your degree of confidence in a tip you intend to sell or share for free on the platform. The GAME Balance balance can be increased by purchasing more GAME units or by achieving a success on your tips. The last Balance balance is the HOLDING Balance balance. The HOLDING balance is a balance that serves as a holder of the revenue you can generate if your tip occurs as analyzed. In the event where your analysis does not hold true, the funds will be reversed to all users who bought that particular tip from you. On the other hand, if your tip holds true, the funds in your HOLDING balance will be transferred to your MAIN balance.I3. It is the responsibility of every user of Tipstake.com to ensure that the name used on registration is their full legal name as is on their bank details and identity credentials. In the event where there is a mismatch in name or names, Tipstake reserves the right to block, or and suspend or and delete, or and ban such users from using the platform without any prior notice. If such actions of blocking, or and suspending or and deletion, or and banning results in the loss of funds of a user, Tipstake shall not be responsible for any such loss.I4. Sending cash out from your MAIN Balance shall undergo due diligence, and shall only be processed successfully if it is found to be gained without any form of fraudulent actions or activities, and as a result cash out may take up to seventy-two hours or more before if reflects in your destination account,

J. DUE DILIGENCE AND AUDIT RIGHTS

In order to perform any transaction, Tipstake may undertake any such verification checks as may be required by ourselves or by third parties (including, but not limited to, regulatory bodies) to confirm the legal ownership and the origin of the money implicated, the identity of the parties and to comply with the relevant Anti Money Laundering Provisions.

K. CASH OUT OF FUNDS

K1. Cash out of funds is permitted from your Tipstake Balance into your Account according to the terms and subject to the limits available.

K2. Once confirmed, the Transfer of funds cannot be reversed to the sender or canceled.

K3. In cases of the user's inability to utilize Balance units. Users are expected to contact the Tipstake representative via mail or otherwise channel provided by Tipstake.

L. INDEMNIFICATION

L1. Your account shall be used exclusively by you and you shall not transfer your account to any third party. If you authorize any third party to manage your account on your behalf, this shall be at your own risk.

L2. Notify us immediately (using our contact details) if you become aware of any disclosure of your password; and be responsible for any activity on your Balance balance arising out of any failure to keep your password confidential, and that you may be held liable for any losses arising out of such a failure.

M. NOTICE

You consent to receive notices electronically from us either by posting to our website, or by email to the email address on your account. All such communications will be deemed to be noticed in writing and received by and properly given to you.

N. TIP UPDATE AND REVIEW

N1. Tipstake is not a bookmaker and its not affiliated to any bookmaker for the purpose of tip outcome determination. Hence, all tip outcome is determined by the trusted system of buyers and sellers. All parties are demanded to update or review their tips, purchased or sold by the expiry date & time of the tip.

N2. If you as a buyer fail to review a tip by the end or expiry date of the tip, the seller's update will be effected on the tip outcome and tipstake will not be responsible for your refund. For Example, You bought a tip for N20K and the tip LOSS, if by the tip expiry date/time, you have not submitted a review and the seller updates the tip sold to you as a WON tip, your N20K will be paid to the seller base on his/her review alone and tipstake will not refund your N20K to you. Hence make it a habit to always review the tips you buy.

N3. If you as a seller fail to update your tip by the expiry date, tipstake.com will will automatically assume you have refused to update your tip because it was lost, Hence it will be assigned a LOSS status and all buyers will be refunded their purchase amount.

N4. If for as scheduled, tipstake performs a system audit and find out that you have submitted a false update of any tip you posted or have falsely reviewed a tip you bought, tipstake reserves the right to suspend or ban you from the platform and all associated funds with such account will not be recoverable in any case.
